Thank you for using Medicawy's services. In order to govern the relationship arising from your use of medicawy.com and the services provided by Medicawy, these Terms of Use ("Terms") constitute a legally binding agreement between you, whether acting as an individual or on behalf of an organization or entity you legally represent, and Medicawy. The user of Medicawy is referred to as ("User", "you", "your", "Second Party"), and the owner and operator of Medicawy is referred to as ("First Party", "Medicawy", "we", "us", "our"). These Terms apply to all users of the platform, including but not limited to patients and/or doctors and/or service providers and/or content contributors and/or healthcare providers. Please note that Medicawy reserves the right to restrict or terminate your use of the services and the platform online if it is established that you have failed to comply with these Terms, or at Medicawy's sole discretion. By using Medicawy, you agree that you have read, understood, and agreed to be bound by these Terms, in addition to any guidelines, policies, or additional terms included on Medicawy. If you do not agree to be bound by these Terms, or if you consider these Terms unsuitable for you, do not enter or use the platform, as your use of the platform, whether as a patient, a doctor, a healthcare provider, or an owner of any medical entity, constitutes your agreement to all of the platform's terms of use.

About Medicawy

Medicawy is a platform specialized in information technology and medical marketing for clinics, medical facilities and healthcare providers. Medicawy aims to help patients book appointments for medical examinations, consultations, and medical services through the Medicawy platform electronically. Medicawy helps patients search for doctors by specialty, geographic location, and doctors' appointment times listed on the platform. It also helps doctors who use the platform to list information about their clinics on the platform, receive bookings from patients, and publish the medical services offered by their clinics. Whereas the First Party (Medicawy) is a product offered to the patient free of charge over the internet, and whereas the Second Party, being the user of Medicawy, whether a "patient, doctor, healthcare provider, or owner of a medical entity," is interested in using Medicawy, the Second Party hereby agrees, without any dispute whatsoever, to all of the following terms and conditions.

Terms:-

1. The user's age must not be less than eighteen (18) years old in order to use Medicawy. The user acknowledges that by using Medicawy and any services or applications associated with it, they are not less than 18 years of age.
2. When the Second Party ("User") registers on Medicawy, this registration constitutes full agreement to all of Medicawy's terms of use. Before completing the registration process, Medicawy requires the Second Party to read the terms of use carefully, and the Second Party (User) must read and fully understand all provisions and terms of use. The First Party (Medicawy) bears no responsibility whatsoever if the Second Party disregards reading the terms of use before completing the registration process. Medicawy's terms of use may be changed, amended, or added to at any time, and these amendments will be published on the terms of use page without Medicawy being required to indicate which provisions have been amended, and without Medicawy being required to deliver any text notifications regarding amendments to the terms of use. The Second Party's continued use of Medicawy's services, and continued access to their registered account on Medicawy, constitutes full agreement to any new or amended term published on the terms of use page.
3. In order for the Second Party ("User") to complete the registration process on Medicawy, the Second Party must use a phone number and email address exclusive to the Second Party, and not previously used on Medicawy. The phone number and email address used in the registration process are used by Medicawy to communicate with the Second Party.
4. Medicawy is merely a platform for coordinating doctor appointment bookings and obtaining medical services from the clinics and medical facilities listed on the platform. Medicawy does not provide medical advice and has no authority whatsoever to provide diagnosis and treatment for patients' medical conditions. Medicawy also does not recommend any particular healthcare provider. Accordingly, the user (patient) bears full responsibility for using Medicawy to book doctor appointments and medical services. Patient users must exercise caution and care when choosing a healthcare provider and take the necessary steps to verify the competence of the healthcare provider. Medicawy fully disclaims responsibility for any damages, losses, injuries, illnesses, deaths, costs, expenses, or any consequences arising from direct or indirect dealings with the service provider, whatever their nature. Patient users (Second Party) acknowledge that Medicawy is not responsible for any consequences resulting from direct or indirect dealings with doctors, owners of medical facilities, and healthcare providers listed on Medicawy, including, for example, the following:-
   • Incorrect or delayed diagnosis
   • Treatment unsuitable for the medical condition
   • Unprofessional, unethical, or disgraceful conduct
   • Medical malpractice or medical errors
   • The healthcare provider's lateness to the appointment, cancellation of the appointment, or failure to attend the examination appointment
5. Medical Emergencies and Non-Use for Urgent Cases: The user (patient) expressly acknowledges and agrees that Medicawy and its application are not tools for handling medical emergencies or urgent cases, and they may not, under any circumstances, be used to seek assistance in medical emergencies requiring immediate medical intervention. In the event the user (patient) or any person under their care experiences a medical emergency or life-threatening condition, they must immediately contact official emergency services (number 123) or go to the nearest hospital or emergency center. The user acknowledges and agrees that Medicawy bears no legal, civil, or criminal responsibility whatsoever for any harm, injury, deterioration of a health condition, or death arising from using the platform or application in an emergency instead of contacting the competent emergency services, and the user expressly releases Medicawy from any claim, lawsuit, or liability arising therefrom.
6. No Medical Relationship between the User and Medicawy: The user (patient) expressly acknowledges and agrees that their use of Medicawy and the application does not, in any way, create a doctor-patient relationship between them and Medicawy, and does not create any obligation or duty of care on the part of Medicawy towards the user. Medicawy is solely an electronic coordination and booking platform, and does not provide any medical, diagnostic, or consultative service, directly or indirectly. Any medical relationship that arises is exclusively between the patient and the doctor or medical facility with whom the booking was made, and Medicawy is not a party to it in any capacity. The user expressly releases Medicawy from any liability arising from a claim that a medical relationship exists between them and the platform.
7. No Recommendation or Endorsement of Healthcare Providers: The user (patient) acknowledges and agrees that the listing of doctors, medical facilities, and healthcare providers on Medicawy does not, in any way, constitute a recommendation, endorsement, or guarantee by Medicawy of the competence, quality, eligibility, integrity, or professionalism of any of them. Medicawy does not independently verify the qualifications, experience, professional record, or medical history of doctors listed on the platform, and does not guarantee the safety or quality of the medical services they provide. Information published about doctors and medical facilities on the platform is purely informational and descriptive, provided by the doctors and facilities themselves, and it is the sole responsibility of the user (patient) to carry out whatever investigations or inquiries they deem necessary to verify the competence and reliability of the healthcare provider before booking and dealing with them. The user expressly releases Medicawy from any liability for any results or damages arising from their dealings with any doctor or medical facility listed on the platform.
8. No Guarantee of Medical Outcomes: The user (patient) expressly acknowledges and agrees that Medicawy does not, in any way, guarantee any medical, therapeutic, or diagnostic outcomes arising from the use of the services of doctors or medical facilities booked through the platform or application. Medicawy does not guarantee the success of any treatment or medical procedure, the accuracy of any diagnosis, or the improvement of the user's health condition, and bears no responsibility for any unsatisfactory results, complications, side effects, or treatment failure. All medical outcomes are the exclusive responsibility of the doctor or healthcare provider dealt with by the patient, and Medicawy is not a party to any dispute arising from medical or therapeutic outcomes.
9. No Provision of Telemedicine Services: The user (patient) acknowledges and agrees that Medicawy and the application do not provide any telemedicine services, remote medical consultations, or remote diagnosis by any means, including phone calls, messages, video, or chat. Medicawy is solely a platform for coordinating and booking in-person appointments with doctors and medical facilities. Any communication between the patient and the doctor through the platform or application is limited to coordination and booking purposes only and does not constitute a medical consultation under any circumstances. The user releases Medicawy from any liability for any harm or health-related damage arising from the user's reliance on any communication via the platform as a medical consultation or medical opinion.
10. No Guarantee of Accuracy of Doctors' and Medical Facilities' Information: The user (patient) acknowledges and agrees that Medicawy does not guarantee the accuracy, completeness, or currency of any information published about doctors and medical facilities on the platform, including, but not limited to: medical specialties, qualifications and certificates, working hours, examination and service prices, clinic and facility addresses, phone numbers, and other descriptive information. All such information is provided by the doctors and medical facilities themselves and may be inaccurate, outdated, or not up to date. Medicawy bears no responsibility for any damages, losses, or inconvenience arising from the user's reliance on inaccurate or outdated information published on the platform, and the user remains solely responsible for verifying the accuracy of information before making any decision based on it.
11. No Guarantee of Appointment Availability: The user (patient) acknowledges and agrees that completing an appointment booking through Medicawy does not constitute a definitive guarantee of the appointment's availability, as the doctor or medical facility may be forced to cancel, reschedule, or modify the appointment for reasons beyond Medicawy's control, including, but not limited to: the doctor's personal emergencies, medical emergencies at the clinic, technical failures, regulatory circumstances, or any other reasons. Medicawy bears no responsibility for any losses, damages, or inconvenience arising from the cancellation, modification, or postponement of any appointment by the doctor or medical facility, and any dispute in this regard shall be exclusively between the patient and the doctor or medical facility. Medicawy undertakes to notify the patient of any cancellation or modification of the appointment if it is informed of such by the doctor or facility, without bearing any responsibility for the delay or non-arrival of the notification.
12. Booking a medical examination appointment or booking an appointment to obtain a medical service with the doctors and clinics listed on Medicawy requires subscribing to the platform and creating a "patient account". Medicawy allows the creation of a "patient account" free of charge, and this account allows the patient to manage their appointments and obtain the necessary technical support from the platform's administration. In the event the user (patient) makes a booking directly using their mobile number and email without creating a "patient account", a new account is automatically created by the platform's electronic system, and the user's login credentials are sent to the patient's email address. Accordingly, the patient must ensure the accuracy of their information, including mobile number and email address, and the user must not share their login credentials with any other person in order to maintain the confidentiality of data and the privacy of the user's account. Requests from any person to obtain the user's login credentials and password must not be responded to under any circumstances, and please be aware that none of Medicawy's staff will ever request the user's password for any reason.
13. If the user is a doctor and/or a medical service provider and/or the owner of any medical entity wishing to join Medicawy to list their medical facility, the user must create a "doctor account" and then add their medical facility after logging into their doctor account. The user (doctor and/or healthcare provider and/or owner of the medical entity) undertakes to submit the certificates and licenses related to the medical facility and to the doctor's eligibility to practice medicine, dentistry, or physical therapy, according to the specialty of the doctor registered under the clinic's name applying to join Medicawy. By virtue of these permits and licenses, the Second Party grants Medicawy the right to use the doctor's private information and page on the platform, and to reproduce, publish, modify, translate, develop, and delete it, and to list the doctor's personal page and information on our platform and any applications associated with it.
14. Additional Terms for Healthcare Providers: In addition to the general terms of use set out on this page, healthcare providers are required to review and comply with the specific terms applicable to their type of medical facility, as follows:
    • Doctors, clinics, and medical centers: Specific Terms of Use for Doctors, Clinics, and Medical Centers
    • Medical labs and laboratories: Specific Terms of Use for Medical Labs and Laboratories
    • Pharmacies: Specific Terms of Use for Pharmacies
    These specific terms are supplementary to the general terms of use and are binding on all respective healthcare providers. In the event of any conflict between the general terms and the specific terms, the specific terms shall prevail with respect to the relevant type of healthcare provider.
15. The user shall be responsible for any use of the password and account (patient account and/or doctor account), including, but not limited to, any use by an unauthorized third party. If the user believes that an unauthorized person or entity has obtained their login credentials and password, or has been able to access their account, the user must notify Medicawy's administration immediately, without delay.
16. The user (Second Party) bears full responsibility for any activity resulting from the use of their account on Medicawy, whether or not the user authorized such activity, and therefore the user must not share their login credentials and password with any other person. In the event of repeated incorrect login attempts more than five times, this will result in the suspension of the user's account to preserve the account's security and safety, and the user must contact Medicawy's administration to reactivate the account.
17. When the user, being a doctor and/or owner of a medical facility and/or healthcare provider, uses Medicawy to list a clinic or medical facility on the platform and its associated applications, and by publishing, storing, or transmitting any content on or to Medicawy, the user thereby agrees to grant "Medicawy" an explicit, exclusive, transferable, sub-licensable, royalty-free, perpetual, and irrevocable right and license to use, reproduce, publish, translate, sub-license, copy, modify, delete, develop, and publish this content, for the purpose of listing that same content on Medicawy and its associated applications. This listing includes the processing and modification of content, including, but not limited to, the services or pages related to clinics, any modifications to photos created and published by the user, or design choices made by Medicawy's electronic platform to manage content published by the Second Party. The user acknowledges their agreement to grant Medicawy the required authorization to carry out all of the actions set out above for the sole purpose of providing the services. The user acknowledges that the First Party's ("Medicawy") use and development of content on Medicawy and its associated applications does not constitute an infringement of any intellectual property rights, copyrights, or trademarks owned by the Second Party. In addition to the foregoing, the user acknowledges and agrees that Medicawy has the right to retain general content not linked to a specific personal identity (such as the general description of the medical services offered, designs, or pages developed by the platform) published by the user on Medicawy, indefinitely, even after the relationship between the First Party and the Second Party ends and even after the user stops benefiting from Medicawy's services, in furtherance of Medicawy's legitimate interest in service continuity and platform stability. This retention does not apply to the user's personal data, the deletion of which is subject to what is set out in the Privacy Policy in accordance with the provisions of Personal Data Protection Law No. 151 of 2020, including the user's right to request deletion of their personal data or withdraw their consent to its retention at any time. The user is fully responsible for the accuracy of the information, publications, medical licenses, or any other information they provide to Medicawy, and its completeness, accuracy, and legality, and the user must, under Medicawy's terms of use, update any information related to the user's content as soon as possible if it changes.
18. Prohibited Activities: The user undertakes not to engage in any of the following activities on Medicawy and its associated applications:
    • Using automated tools, programs, or scripts (bots) to extract, collect, or copy data from the platform (scraping/crawling).
    • Creating automated or repeated bookings in a manner that disrupts or impedes the operation of the platform or affects the experience of other users.
    • Attempting to reverse-engineer, decrypt, or access the source code of the platform or application.
    • Interfering with other users' accounts or attempting unauthorized access to any part of the platform.
    • Impersonating any individual, organization, or other entity, or misrepresenting affiliation with a person or entity without permission.
    • Using the platform to create a competing or similar service, product, or platform.
    • Transmitting or distributing any viruses, malware, or spyware that may harm or disrupt the platform's systems.
    • Collecting or harvesting other users' data (such as phone numbers or email addresses) without their consent.
    • Sending unsolicited messages (spam) or engaging in unauthorized marketing activities through the platform.
    • Attempting to bypass the platform and communicate directly with patients outside the platform to avoid any fees or obligations.
    • Manipulating examination or medical service prices in a manner contrary to applicable laws or the rules published on the platform.
    In the event a user violates any of these prohibitions, Medicawy has the right to immediately cancel their account and prevent them from using the platform, without bearing any responsibility for any damages that may result therefrom.
19. The Second Party is prohibited from sending or publishing any illegal content or content that infringes the legal rights of any third party on Medicawy. Nor may the Second Party send content that has previously been subject to any actual or threatened legal proceedings, or any content that may lead to legal action under any applicable law, whether against you, against us, or against any third party. The Second Party acknowledges their agreement that they alone shall be responsible for any consequences that may arise from sending illegal content or content that infringes intellectual property rights, including the use of content belonging to other websites, other entities, or third parties.
20. The First Party (Medicawy) is not obligated to monitor content published by the Second Party or other users on the platform. The First Party does not endorse or support any content published on the platform or the opinions expressed therein, and does not guarantee the truthfulness, accuracy, or objectivity of any content published on the platform. The Second Party acknowledges their agreement that the First Party (Medicawy) is not responsible for any damage or loss the Second Party may incur as a result of interacting with other users on the platform, and Medicawy is not obligated to participate in any such dispute. The Second Party may not claim that the First Party presented or supported content published by the Second Party. The Second Party's use of, or reliance on, any content published on the platform is at their own risk, and the Second Party bears all risks associated with the content they send.
21. Medicawy respects the intellectual property rights of others, and the platform's administration may delete any content published by users if it is established, or appears to Medicawy's administration, that it infringes the intellectual property rights of others. Medicawy's administration has the right, at its sole discretion, to close the accounts of users who infringe the intellectual property rights of others. If a user finds that another user of Medicawy or its associated applications has infringed their copyrights or trademarks, or those of a third party, please notify Medicawy's administration by email through Medicawy's contact channels.
22. Medicawy's Intellectual Property Rights: All rights related to the name "Medicawy", the logo, design, software, and content published on the platform (excluding user content) are the exclusive property of Medicawy and are protected under applicable intellectual property laws in the Arab Republic of Egypt and international laws. The user may not use the name "Medicawy", its logo, its trademarks, or any of its content for any commercial or non-commercial purpose without obtaining prior written permission from the platform's administration. All rights not expressly granted in these Terms are reserved by Medicawy.
23. Medicawy and its associated electronic applications may contain links to third-party websites, advertising companies, or services that are not owned or controlled by Medicawy. Medicawy bears no responsibility whatsoever for any content, privacy policies, private practices, or activities conducted on third-party websites or their services, and Medicawy's terms of use and privacy policy do not apply to your use of these websites. If the user (Second Party) clicks on third-party links and accesses their websites and electronic applications, the user shall bear full responsibility therefor, and accordingly the user fully releases Medicawy from any liability arising from the user's use of any third-party websites, their services, or their content. Any dealings or use of promotional advertisements from advertising companies present on the platform, including payment, delivery of goods, and any other terms (such as warranties), shall be a matter strictly between the user and the advertising companies. The user acknowledges their agreement that the First Party (Medicawy) bears no responsibility for any losses or damages arising from the user's dealings with advertising companies or with third-party websites.
24. Medicawy operates on high-quality servers to ensure a good level of service, and Medicawy's administration takes the necessary measures to secure the platform's pages and databases against hacking, malicious software, and hacking attempts. However, Medicawy does not guarantee it will be completely secure against cyberattacks and attempts to breach users' data. Furthermore, Medicawy does not guarantee it will be permanently available on the internet, does not guarantee that the services provided on the platform will be available at all times, and does not guarantee that the content published on the platform, whether by the platform or by healthcare providers and owners of medical facilities, will be accurate, complete, or free of errors. Access to and use of Medicawy by users is entirely at the user's own responsibility.
25. Medicawy's administration may remove, modify, or delete any content sent, published, or stored on the platform or our servers without prior notice. Medicawy is not obligated to store or back up any content published by the Second Party. Therefore, the Second Party acknowledges their responsibility for keeping backup copies of any content the Second Party wishes to retain.
26. Medicawy reserves the right to modify, add to, suspend, or terminate all or part of the platform and its associated applications and services at any time without providing you with prior notice. This includes the right to impose limits on the user's use of the services and data storage.
27. Ratings and Reviews: Medicawy allows patients to rate doctors and medical facilities after completing a visit. The user undertakes to abide by the following rules:
    • Ratings and reviews must be honest and based on an actual experience with the healthcare provider.
    • Publishing false, defamatory, misleading, or retaliatory ratings is prohibited.
    • Publishing personal or confidential medical information in ratings is prohibited.
    • Doctors are prohibited from incentivizing or threatening patients to obtain positive ratings.
    • Any party is prohibited from paying money or offering benefits in exchange for positive ratings.
    • Medicawy has the right to delete any rating that violates these rules without prior notice.
    • Medicawy bears no responsibility for the content of ratings and reviews published by users.
28. Verification of Medical Credentials and Licenses: The user (doctor and/or healthcare provider and/or owner of the medical entity) acknowledges that all medical certificates and licenses submitted to Medicawy are valid and in effect. Medicawy has the right to request copies of these documents but is not obligated to independently verify their validity or authenticity with the competent authorities. The user bears full responsibility for the validity and truthfulness of the documents submitted, and in the event any license or certificate is found to be invalid, Medicawy has the right to delete the user's page and immediately cancel their account without bearing any responsibility. Medicawy bears no legal, civil, or administrative responsibility in the event it is discovered that any doctor's documents or licenses are invalid or have expired.
29. Compliance with Medical Advertising Laws: The user (doctor and/or healthcare provider and/or owner of the medical entity) undertakes that all information, descriptions, and services published on their page on Medicawy comply with the medical advertising laws applicable in the Arab Republic of Egypt, including the Medical Practice Law and the Medical Advertising Law. The user bears full responsibility for any violation of medical advertising laws, including, but not limited to:
    • Advertising unlicensed medical services.
    • Using medical titles not granted to the user (such as affiliation with an unlicensed specialty).
    • Advertising treatment results or guarantees not scientifically supported.
    • Publishing prices in violation of the limits set out in laws or ministerial decisions.
    Medicawy has the right to delete any content that violates medical advertising laws without prior notice, and Medicawy bears no responsibility for any legal or regulatory action that may be taken against the user due to their violation of these laws.
30. Notifications and Electronic Messages: By using Medicawy and the application, the user agrees to receive notifications and messages related to their use of the service, including, but not limited to: booking confirmations, appointment reminders, booking cancellation or modification notices, account security notifications, and service updates, and these notifications may sometimes include promotional or marketing content. The user retains the right to stop or disable receipt of any of these notifications, in whole or in part, at any time and at their own discretion, through their account settings, application settings, or device settings. The user acknowledges and agrees that Medicawy bears no responsibility for any results, damages, or losses arising from the user's failure to receive any notification or alert, including material notifications related to bookings, appointments, or account security, in the event the user disables notifications in whole or in part, and the user alone remains responsible for independently monitoring their account and bookings in such case. The user agrees that all notices, disclosures, agreements, and communications provided electronically by Medicawy satisfy any legal requirement that such communications be in writing.
31. Indemnification and Release of Liability by the User: The user, regardless of their capacity (whether a patient, doctor, healthcare provider, owner of a medical entity, or any other capacity), fully and absolutely undertakes to indemnify Medicawy and hold it harmless from all claims, lawsuits, losses, damages, legal expenses, fees, litigation costs, and any other costs of any kind, including attorneys' fees, that may arise from or relate in any way, including, but not limited to: (a) the user's use of the platform or application, or misuse thereof, or exceeding the limits of authorized use, (b) the user's publication of false, defamatory, misleading, or retaliatory ratings or reviews, (c) the user harassing or harming any doctor, medical facility, or other user through the platform or application, (d) the user's violation of, or exceeding, any provision of these Terms of Use, (e) the user committing any act that violates any law, regulation, or right of a third party, including intellectual property rights, copyrights, and trademarks. This indemnification includes all legal expenses, attorneys' fees, and litigation costs incurred by Medicawy in defending itself before any judicial, administrative, or regulatory authority against any claim or lawsuit for which the user is directly or indirectly responsible for causing. The user acknowledges that their obligation under this indemnification is a standalone obligation independent of any other obligation, and does not prejudice any of Medicawy's other legal or contractual rights, and all of Medicawy's rights to take whatever legal action it deems necessary to protect its interests remain fully reserved.
32. Limitation of Liability: To the maximum extent permitted by applicable law in the Arab Republic of Egypt, Medicawy shall not be liable in any way for any indirect, incidental, consequential, or punitive damages, including, but not limited to: loss of profits, loss of data, business interruption, or any other losses resulting from the use of the platform or services, or from the inability to use them, regardless of the cause of such damages or the legal basis on which the claim is based.
33. Force Majeure: Medicawy shall not be liable for any failure or delay in performing its obligations arising from these Terms if this is due to circumstances beyond its reasonable control, including, but not limited to: natural disasters, epidemics and pandemics, wars and armed conflicts, governmental actions or regulatory decisions, disruption of internet or communication services, technical failures in internet infrastructure, strikes, cyberattacks, or any other uncontrollable or unforeseeable event. If the force majeure event continues for a period exceeding 30 days, either party has the right to terminate this agreement by written notice to the other party.
34. Terms of Paid Subscriptions for Pharmacies and Medical Labs: With respect to paid services on Medicawy (such as subscriptions for pharmacies, medical labs, and laboratories):
    • Fees: Subscription fees are determined based on the chosen package in accordance with the prices published on the platform at the time of subscription.
    • Subscription Duration: The subscription period begins from the date of payment confirmation and continues for the agreed-upon period (annual, semi-annual, etc.).
    • Non-Payment: In the event subscription fees are not paid by the due date, Medicawy has the right to suspend or cancel the services provided to the pharmacy or medical lab, including hiding its page and preventing it from receiving orders or bookings.
    • Refund Policy: Subscription fees are non-refundable after the service is activated, unless the law provides otherwise.
    • Price Changes: Medicawy has the right to modify subscription prices at any time, and such changes shall apply to new subscriptions or upon renewal of the subscription, and shall not affect existing subscriptions until their term expires.
35. Reasons for Account Suspension or Termination: Medicawy has the right to suspend or terminate the account of any user from among (doctors, healthcare providers, pharmacies, and medical labs) in the following cases:
    • Providing false information or invalid or expired medical licenses.

    • Violation of medical advertising laws or laws governing the practice of medical professions.
    • Using the platform for illegal or fraudulent activities.
    • Attempting to bypass the platform or communicate with patients outside it to avoid fees.
    • Extracting data or using automated tools for scraping or collection.
    • Infringing the intellectual property rights of others.
    • Publishing offensive, defamatory, or misleading content.
    • Attempting to hack the platform or gain unauthorized access to its systems.
    • Non-payment of subscription fees (for paid services).
    In all cases, Medicawy bears no responsibility for any losses or damages that may result from the suspension or termination of the account.
36. Terms of Use of the Mobile Application: With respect to the Medicawy mobile application:
    • The application is provided "as is" without any warranties.
    • Medicawy bears no responsibility for any issues related to app stores (App Store / Google Play) or their policies.
    • The user must use the latest version of the application to ensure optimal security and performance.
    • Use of the application is subject to these Terms of Use in addition to the terms of the app stores.
    • Medicawy bears no responsibility for the application's incompatibility with certain devices.
37. Privacy Policy and Its Acceptance: The user acknowledges and agrees that Medicawy's Privacy Policy, published at this link, constitutes an integral and binding part of these Terms of Use. By accepting these Terms of Use, the user acknowledges that they have reviewed the Privacy Policy and agreed to its provisions regarding the collection, processing, storage, use, and protection of their personal data. The user undertakes to refer to the Privacy Policy for details of their rights and obligations relating to their personal data, and in the event of any conflict between these Terms of Use and the Privacy Policy with respect to personal data matters, the Privacy Policy shall be the governing reference in this regard.
38. Medicawy's Role in Processing Personal Data: With respect to the processing of personal data in accordance with Personal Data Protection Law No. 151 of 2020:
    • With respect to patient data: Medicawy acts as a "Data Processor" on behalf of the doctor/medical facility, which is considered the "Data Controller".
    • Medicawy's role is limited to processing booking data for the purpose of providing the coordination and booking service.
    • Doctors and medical facilities are responsible for complying with patient data protection obligations as data controllers.
    • Medicawy is committed to applying appropriate technical and security measures to protect personal data in accordance with the law.
39. Visiting and using the services of this platform (Medicawy) and the platform's terms of use are governed by the laws of the Arab Republic of Egypt. These Terms of Use shall be interpreted in accordance with the laws of the Arab Republic of Egypt, and shall be expressly and irrevocably subject to the exclusive jurisdiction of the courts of the Arab Republic of Egypt. Any dispute relating in any way to the Second Party's use of Medicawy shall be settled in the courts of the Arab Republic of Egypt.
